As of this point in Facebook land, children under 13 are not legally allowed to have an account.  HOWEVER, lots do. A recent Consumer Report said that 7.5 million kids under 13 have accounts anyway, and have lied about there age.

Facebook has identified the problem, and are working on a solution.  Kids under 13 would be allowed to have an account, that would be attached to their parents.  This would allow  parents to decide who their kids can "friend" and what apps they can use.  What do you think?  Should kids have Facebook accounts? At what age is it ok?
