Lindsay Lohan wants to go to trial in her felony grand theft case, Los Angeles prosecutors confirmed to PEOPLE Wednesday. The actress's lawyer, Shawn Chapman Holley, formally notified the judge that she didn't want to take the plea deal that included jail time and three years probation.

The 24-year-old is accused of felony theft by a jewelry store owner who says the actress stole a $2,500 necklace in January. Lohan insists she's not guilty; she thought the necklace was loaned to her.

A preliminary hearing is scheduled to being on April 22. If the jury finds her guilty, Lohan faces a maximum of three years in prison. She also could face jail time if a judge decides the charges are a violation of her probation in an unrelated DUI case.
