Will she ever learn?  Looks like there is a good chance Lindsay Lohan is headed back to the slammer!  All for a necklace she could have easily purchased!  This is nutzo!

Lindsay Lohan appeared in court on Wednesday (February 23rd) where Judge Keith Schwartz told the starlet that a plea of guilty or no contest in her felony grand theft case would definitely result in jail time.

Judge Schwartz told Lindsay: ["I've never met you before the last court appearance you never met me, to my knowledge. One of the things about me is I treat everybody the same. I don't care that you are Lindsay Lohan verses John Doe, Jane Doe that doesn't affect me. What I look to in sentencing, if there is a resolution in my court is what are the charges, what's the prior record, things of that nature. Now on this particular case there has been so much speculation in the press, all of the talking head attorneys who talk about 'what the judge is going to do, what Miss Holley's going to do, what Ms. Meyers going to do.' Well I'm just going to tell you a couple of the things, if the case settles in this court, will happen. Number one, this case does involve jail time. Period. If you plead in front of me this case is resolved in front of me, you are going to jail. Period."] SOUNDCUE (:55 OC: . . . to jail. Period.)

* Schwartz also said that he thinks Lohan should receive psychological counseling as a condition of her probation if it is re-instated.

* Lindsay has until March 10th to decide whether she will accept a plea deal or go forward with a preliminary hearing. Because her lawyer only received key evidence from the prosecution this week, the judge is giving Lohan's lawyer, Shawn Holley, time to look everything over before they decide on a plea.

LINDSAY GOING TO JAIL NO MATTER WHAT?

TMZ.com reported that Lindsay is likely going to jail whether she pleads guilty or not. Because the judge ruled that Lindsay's preliminary hearing and probation violation case will be heard at the same time -- he can immediately send her to jail at the end of the preliminary hearing if he feels it's more likely than not that she stole the necklace. She would then remain behind bars while awaiting trial on the grand theft case.

Sources also told TMZ that the plea deal the D.A. offered Lohan's lawyer in chambers on Wednesday involved Lindsay serving six months in jail.

* Because of the significant jail time currently attached to the plea deal, Judge Schwartz said in court that he believes Holley will pass on the offer. Since jail time is likely involved either way, TMZ speculates that Holley will eventually plead guilty or no contest on behalf of her client and hope Lindsay is given less than six months.

WAS HER OUTFIT APPROPRIATE?

After her tight mini-dress created a stir at her last court appearance, Lindsay covered up her legs on Wednesday -- but her outfit wasn't completely conservative.

* The starlet donned white pants, a low-cut black blouse and high-heeled black shoes to court. Sources close to Lindsay told TMZ that she tried on a handful of outfits before the hearing and ultimately picked the one she thought was "most reserved."
