Just in case you are wondering, a PDA is a public display of affection. It can range anywhere from a hug, a kiss to full blown sexual relations in public.

As far as 100 years in the clink? That is the maximum term one person could possibly get by having sex, exposing themselves, or any of the like in public and that is after the third offense, kind of sounds like a three-strike rule, you go to jail for pretty much the rest of your life.

According to Montana code 45-5-504, indecent exposure is explained as a person committing the offense of indecent exposure if the person knowingly or purposely exposes the person's genitals under circumstances in which the person knows the conduct is likely to cause affront or alarm in order to:

  • Abuse, humiliate, harass, or degrade another
  • Arouse or gratify the person's own sexual response or desire or the sexual response or desire of any person.

I'm mostly highlighting the second stipulation, this can range from having sexual relations in a car, behind a dumpster, in your front yard or whipping what you have out for the whole world to see.

Fines, court, and jail time can get pretty steep when one persists in lewd public acts.

First:

In Montana, 1st offense will get you fined not exceeding 500 bucks, and a maximum of 6 months in jail, and in some cases both.

Second:

Next offense, everything doubles. It's a possible 1,000 dollar fine and a maximum of 1 year in jail. Just as before both instances may apply at the same time.

Third:

Like a cow trotting into a pot field, the stakes cannot get any higher with this third offense. The third time or any time after someone decides to break this law in Montana will be imprisoned for life or in prison for no less than five(5) years and not exceeding 100 years. and there will be a fine no more than 10,000 dollars.

Those numbers get overwhelming pretty quick and this code still holds in the 21st century.

Most people learn their lesson after the first offense so I wouldn't fret about that hundred year sentence.
